General terms and conditions: scope of application for online purchases:
§1:Online purchase is only possible for end users (B2C). The latest version of our terms and conditions will apply. Practice differing from our terms and conditions will require the written agreement of Mag. Stefan Gruber.
§2: Privacy: Personal data is processed in accordance with privacy protection law. Third parties can only be involved for the process of handling orders.
§3: conclusion of contract and reservation of proprietary rights: a sales contract with persons under the age of 18 requires the signature of their legal representative. The display of sale items in the webshop represents an offer. By making an online order, the customer is placing an official shopping bid. Orders by cash on delivery are possible, but they require prior notification and confirmation of the vendor. In case an item should not be available for sale, Mag. Stefan Gruber has the right to withdraw from the contract. He is then obliged to refund the purchase price to the customer. Until full payment is received, the item remains property of Mag. Stefan Gruber.
§4: Shipping costs and return policy: Shipping costs will be paid by the customer. In case the delivered item does not match the item which was ordered, Mag. Stefan Gruber will pay for the costs. For items up to 470â‚¬ of merchandise value, Shipping will cost 6â‚¬within Austria and 12â‚¬ within the EU. Items with a merchandise value of 470â‚¬ and up will be sent as consignment of valuables only. Reshipment costs will have to be paid by the customer. The purchase price will be reimbursed. In the case that damage or impairment of value has occurred to the item, that amount will be substracted from the reimbursement value.
§5: warranty: In case of mistakes in writing or arithmetic errors, the vendor has the right to withdraw from the contract. Products displayed in the webshop may slightly differ in color and size from how they look like in reality. Obvious material defects must be reported to Mag. Stefan Gruber within 14 days after contract conclusion. Otherwise, any right of supplementary performance expires. Provided that the delivered ware shows defects, Mag. Stefan Gruber takes charge of supplementary performance. If this not possible, the contract will be canceled. In the case of a major defect, shipping will be paid by Mag. Stefan Gruber. A compensation for violation of contractual relationship is only to be paid to the customer if Mag. Stefan Gruber's has violated either the contractual relationship or other legal obligations with intent or by gross negligence.
§6: The agreement is construed in accordance with and is subject to Austrian law. Place of venue is Vienna, Austria.
